President Rodrigo Duterte has issued an executive order aimed at improving the government’s measures to achieve its goal of total household electrification by 2022.
Duterte issued Executive Order 156 on December 9, a copy of which was shared to the media on Saturday.
Among the salient features of the EO is the transferring of the power to exercise step-in rights and take over ailing electric cooperatives (ECs) from the National Electrification Administration (NEA) to the Office of the President (OP).
Citing the Section 17, Article VII of the 1987 Constitution, the President said that the chief executive shall have control of all executive departments, bureaus and offices.
Likewise, the Administrative Code of 1987 vests the President with the continuing authority to transfer any function from any department or agency to the OP.
“The NEA exercises supervision over electric cooperatives and is empowered under Republic Act 10531 to exercise step-in rights and take over the operations of any ailing electric cooperative,” the EO read.
“While electrification of the entire country is one of the primary concerns of the government, certain distribution utilities, as well as ailing cooperatives, continue to underperform, and thus hamper government efforts for the country’s total electrification.”
Duterte also ordered the Department of Energy (DOE) identify unviable, unserved, underserved and poorly served areas within the franchise areas of distribution utilities.
The DOE is also tasked to mandate all distribution utilities to submit within 30 days from the effectivity of the EO a comprehensive master plan for the total electrification of their respective franchise areas.
The Energy Regulatory Commission (ERC) is also directed to impose fines and penalties against non-compliant distribution utilities and recommend to Congress the revocation of their franchises, as may be warranted. — VBL, GMA News
